Jet Vacations LLC Terms and Conditions Policy for Groups

The general Terms and Conditions and Passenger Agreement below are in effect, unless otherwise indicated on the specific tour and/or group leader master contract.  Latest Terms & Conditions and Passenger Agreement are readily available online at www.JETVACATIONS.COM

This Passenger Agreement and Terms and Conditions form the basis of the contract between You ((you; I; My; Passenger(s); Traveler(s); Guest(s); Client(s); Customer(s); Individual(s); Participant(s)) who is bound by the following Passenger Agreement / Terms and Conditions and Jet Vacations LLC (“Jet Vacations”; “We”, “Us”;“Our”; “Affiliates”).

PASSENGER AGREEMENT: By signing a Booking Form or by confirming a Jet Vacations’ Reservation with deposit/Payment, the Passenger acknowledge that he is aware and will comply with these Passenger Agreement and Terms and Conditions prior to travel and, by so doing, formally accepts and abides to Jet Vacations LLC Terms & Conditions and Passenger Agreement. Passengers booking online have access to the Passenger Agreement including the full Terms and Conditions at https://www.jetvacations.com/terms---conditions.html at the time of booking. Passengers booking via telephone are also provided with the Passenger Agreement and Terms and Conditions, which are delivered via email shortly after the time of booking.  Passengers who are unable to receive the Passenger Agreement and Terms and Conditions via email may request the Agreement and Terms and conditions to be sent to them via fax or mail.  Jet Vacations LLC reserves the right to cancel bookings and return deposits without a completed Booking form or a Reservation with payment. The Passenger Agreement incorporates the Terms & Conditions including the following Release from Liability, Assumption of Risk and Binding Arbitration Clauses. Completion of a Jet Vacations’ reservation with payment constitutes agreement to these Passenger Agreement, Terms & Conditions and Jet Vacations LLC’s Release from Liability, Assumption of Risk and Binding Arbitration Clause.

Service fee: (unless otherwise indicated on the specific tour): You agree to pay the travel planning, change, and other fees assessed by Jet Vacations for all work performed by our staff to process your registration and make all reservations for your trip (Air, Hotel, Cruise, documents, and answer all communications Q&As via email, phone, etc..).  All of our fees are non-refundable. 

Deposits: Air / Hotel / Cruise space has not been requested or confirmed for your group at this time.  In order to proceed with air, land and/or cruise operations, We require a group service fee/deposit as stated in the “Service fee / Deposit” section of the Booking Form. Hotels / cruises confirmed will be as indicated or similar, depending on space availability at the time of booking. Registering on a tour requires a minimum deposit of $600 per person inclusive of taxes & fees (unless otherwise stated in a proposal).  30 days after booking / registering on a tour with Jet Vacations LLC, a Service Fee of $300 will become non-refundable.  Cancellation fees will not be less than the initial non-refundable Service Fee.  Cancellation penalties apply. (See Cancellation Penalties section). Generally, bookings made more than 120 days (150 days for cruise programs) from departure will require only a Service Fee/Deposit.  Some programs may require You to purchase non-refundable airline tickets at the time of booking, in addition to the required tour service fee/deposit. There may also be other exceptions.  Final payment is due as specified on your invoice. If final payment is not received by the date it was due, Passenger authorizes Jet Vacations LLC to charge his/her credit card on the final payment day and Jet Vacations LLC will automatically charge the balance due to the Passenger credit card on file if provided.  If You are using a Debit Card as a Credit Card, your financial institution may set limitations and restrictions. Please check with your bank or financial institution before submitting your reservation or final payment.  All rooms / cabins are based on “run of the house” category and supplements may apply to guarantee specific room / cabin category preferences.  On occasion, hotels / cruise lines may require a larger group service fee/deposit in order to block space.  We will advise You of these requirements if they are requested.

Price Drops: If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.

Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.

Venue selection: It is the responsibility of Passenger to ensure that the hotels / cruises / venues that are suggested and selected in this proposal are adequate for them.  Jet Vacations LLC cannot and will not be responsible for room / cabin sizes, air condition, amenities, service which vary and differs throughout the world, countries, cultures and hotels / cruises. We strongly advise client to peruse hotel / cruise rating web sites such as Tripadvisor.com to get an approximate “feel” and “judgment” on each suggested and selected properties, to ensure that selected hotels rooms and/or cruises cabins will be adequate to the Passenger.  Passenger understands that no refund nor legal claims regarding the selected hotels / cruise, venues, rooms / cabins and/or services will be possible once the Booking Form has been signed or the Reservation with Payment has been received and therefore agreed upon.

Accommodations:  If a hotel – cruise substitution must be made, a comparable class of hotel – cruise ship will be used.  Single rooms / cabins in Europe are usually small and often not as well situated as double rooms / cabins.  Any complaint regarding the hotel / cruise ship must be brought to the attention of the hotel / cruise management as early as possible during your stay and, if not resolved to your satisfaction, should be notified to Jet Vacations LLC in writing. In the unlikely event that the hotel / cruise management cannot provide the booked accommodation, the client understands that the hotel / cruise management responsibility is to find an alternative of at least a similar standard, and provide transportation as appropriate to this alternative hotel / cruise ship.  Jet Vacations LLC shall have no liability in respect of any other costs, losses or damages existing out of or in connection with existing travel arrangements, relocation of accommodation since such relocation is outside Jet Vacations’ control.
(a) Your accommodation:  All successful confirmations will generate travel documents or a Voucher with a reference number, which is shown on the hotel / cruise ship travel document / voucher provided by Jet Vacations LLC. This hotel / cruise ship travel document / voucher shows the details of the booking made with the hotel / cruise ship. It is important that You check the hotel / cruise line details and itinerary are correct to eliminate all possibility of misunderstanding. You must take your travel documents / voucher with You to the hotel / cruise ship. Likewise, if You do not receive a confirmation via email after making the booking, then please contact us. 
(b) Alterations at the hotel / cruise:  Should You decide to alter the arrangements at hotel or cruise ship, the hotel / cruise ship will do its best to accommodate such arrangements, but neither the hotel / cruise ship nor Jet Vacations will not be held responsible should they fail to do so.

Hotels / Cruise Check-in times: Hotel rooms and Cruise ship cabins are usually not ready for check-in until after 3 pm.  If your flight is arriving early, especially European flights, You should plan for the day's activity until your room / cabin is available. Most hotels / cruise ships will store your luggage until your room / cabin is ready.

Air Conditioning: Jet Vacations LLC is not responsible for air conditioning standards or availability, as these factors can vary greatly between properties and countries

Single, Triple, Quad Accommodations: are limited and subject to availability.  The single Triple or Quad rates are quoted on the basis that single, triple and Quad rooms / cabins shall not exceed approximately 20% if the total rooms / cabins required, unless otherwise agreed and confirmed.  Some hotels / cruise lines may charge an extra fee should the group exceed this configuration.

Drinks, Meals and Dietary requirements: As specified in each itinerary, meals are based on the hotel's / cruise ship’s or restaurant's buffet or set menu.  In general, beverages (including but not limited to: juices, tea and coffee, mineral water, wine, beer or other alcoholic beverages) are not included, unless specifically stated. Where wine is included with a meal, it is done so on the basis of house white or red wine.  No refunds for meals not taken in a hotel, restaurant or when included or onboard an aircraft, train or cruise ship.  Dietary request and preferences should be provided at the time of booking or submitted in writing at least 72 hours prior to departure at https://www.jetvacations.com/contact-us.html. Although Jet Vacations LLC cannot make any guarantees, every effort will be made to honor special dietary requests. Terminology for dietary requests can vary from country to country. Therefore, We recommend that You make your wishes known to your tour director upon arrival, and at each hotel/cruise restaurant.

Items not included:  Jet Vacations LLC programs do not include items of a personal nature such as laundry, hotel extras, Spa or wellness centers, telephone or Wi-Fi charges and drinks with meals (unless otherwise stated in a proposal).  All passengers are responsible for settling such accounts before checking out of each hotel / cruise ship.  Hotels, cruises, airport and airline taxes and fees are not included unless specified.

Airport to Hotel / Ship’s Pier transfers: Round-trip airport transfers to hotel or to ship’s pier may be included when the tour is purchased air-inclusive (check details of your tour to see what is included).  If You make your own air arrangements, travel from a non-group airport, or extend your vacation, transfers are not included.  Transfers may, however, be arranged upon request at an additional cost.

Baggage Handling:  One piece of standard airline baggage per person is included unless otherwise specified.  Passenger bringing baggage in excess of this amount may incur a surcharge.  For the sake of Passenger’s comfort, it is recommended that Passenger limit baggage to 1 suitcase per person plus 1 carry on.  Airline baggage fee policies differ from airline to airline and fees may apply to check your baggage.  Please contact the airline on which You are traveling for specific rules and baggage fees.  On escorted coach trips, our tour Directors may assess a onetime fee of $25 per piece if You exceed your luggage allowance of one piece of luggage on a coach tour.  You may also bring one carry-on bag that complies with the airline rules and must fit either under your seat, or in an overhead compartment.  It is your responsibility to carry this bag.  Baggage handling, if included, begins curbside at the airport upon arrival and is limited to one bag per person and consists of loading/offloading the bag on and off a coach.  You are required to handle your own baggage if transferring between the coach to the airport terminals – train stations.  On all tours, You are responsible for complying with the airline regulations concerning their baggage allowances and with the airline restrictions on the size, weight and contents of your carry-on bags. You may be disappointed if You are carrying items of necessity in your carry-on bag, and the airline asks You to check it in at the airport because it didn’t meet their requirement. You will be responsible to pay for any additional baggage charges imposed by the airline or transportation companies. Check with the carrier for luggage guidelines. Luggage travels at owner’s risk throughout. We are not responsible for loss or damage of luggage or personal belongings. Our protection plan is strongly recommended to cover loss or damage of luggage.  Jet Vacations LLC nor its representatives/suppliers, assumes no responsibility for loss of, or damage to, baggage or any Passenger’s personal belongings.  It is recommended that Passenger purchase baggage insurance. 

Planning and Operations:  An initial Service Fee/Deposit is charged with all new reservations.  This initial Service Fee / Deposit is non-refundable and allow our staff to answer your questions and work on your behalf and make all the necessary reservations, book all the arrangements, obtain confirmations, prepare and send all travel documents pertaining to your trip and work with all the travel suppliers such as Airlines, Hotels, Cruise lines, Coach companies, Tourist sites, guides, travel insurance and more.

Foreign Entry Rules: You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.

Visas, passports and inoculations:  Jet Vacations LLC DOES NOT PROVIDE PASSPORT, ID, OR VISA SERVICES.  All travelers are responsible to contact the consulate of the country and/or countries they are traveling to for entry requirements and necessary documents, such as visas. For the latest information on travel requirements, log on to the consulate websites or www.Trave.State.Gov. As of the time of posting, a valid Government-issued photo ID is required at time of check-in for all U.S.A domestic flights. From October 1, 2020, You will need a REAL ID compliant license or another acceptable form of ID, such as a passport or military ID.  The easiest way to spot if your state ID is a Real ID, is if there’s a star in the top right hand corner.  The availability of REAL ID varies from state to state. We recommend contacting your local government for more information. If You can, update your state driver’s license or ID card so that it meets REAL ID standards before October 1, 2020.  A valid passport is required for travel outside the United States. If possible, You should renew your passport approximately nine (9) months before it expires. The U.S. State Department recommends that all travelers’ passports remain valid for six months beyond their expected return date. Airlines have refused boarding to travelers on flights to certain countries based on their immigration requirements.  Sufficient Blank Pages in Passport Book – The U.S. State Department recommends that all travelers’ passports have a minimum of at least two blank pages left or travel may be refused to certain countries. Some airlines will not allow You to board if this requirement is not met and Jet Vacations LLC will not be responsible for denied boarding or refusal of entry in any country. Select countries require additional documentation for children under the age of 18 years.  Passenger is responsible for proper documentation and inoculations that may be required and/or recommended to participate on a tour.  Non-U.S. citizens may have different entry requirements than U.S. citizens.

Tariff, fuel surcharges and Exchange Rate Fluctuations:  All prices are quoted using the prevailing rate of exchange between the Foreign currency and the USD from the date the original offer was made.  If the rate of exchange changes by more than 4%, Jet Vacations LLC reserves the right to revise the selling rates according to the current exchange rate between the Foreign currency and the USD.  Jet Vacations LLC reserves the right to change the price of the tour/program before it commences due to fuel surcharges, currency fluctuations, tariff increases from common carriers and suppliers, etc.  If there is a surcharge to be applied such notice will be given no later than 30 days prior to the start of the tour or program.
IMPORTANT NOTE ON FUEL SURCHARGES: Fuel surcharges imposed by the airlines are valid at time of contract and are included in the price of your tour when stipulated.  As fuel continues to fluctuate, if the fuel surcharges change prior to your departure date, You will be assessed this additional amount.

Air arrangements:  We negotiate special Economy class rates with many major carriers, as well as chartered air carriers.  Fares and schedules are based on regular scheduled carrier service. All applicable airline rules apply and schedules are subject to change. Basic airfares include fuel surcharges, airport departure taxes, passenger facility charges (PFCs), customs or immigration fees, when stipulated.  We cannot be responsible for flights that are occasionally overbooked, delayed, or canceled by the airlines.  All fares and schedules are subject to change without notice. If the airline imposes higher fares, Passenger is required to pay the additional amount. Late bookings are most likely to result in higher airfare.  Air inclusive group packages are non-changeable and non-refundable once deposit has been paid.  Lost paper tickets have no refund value.

Contact Information: Pursuant to TSA Secure Flight requirements, Passengers traveling internationally are responsible to provide Jet Vacations LLC with their name as it appears on their passport (or other government-issued REAL I.D. when traveling domestically), date of birth, gender, address, phone number, email and fax data for all passengers. It is the Passengers’ responsibility to ensure that names are correctly listed on their invoice.  Jet Vacations LLC will not be responsible for Passengers who do not receive an invoice or documents or are denied boarding due to inaccurate information.

Air deviations:  Routing deviations are not permitted and must be booked and ticketed separately from the group.  Date deviations are permitted on the westbound sector of the itinerary only.  A $50 per person non-refundable fee applies, as well as any additional fees and/or fare differences imposed by carrier. 

Flights, frequent flyers miles:  We negotiate special Economy class rates with many major carriers, as well as chartered air carriers.  Air arrangements are subject to restrictions on choice of routing, direct or non-stop flights, arrival times, eligibility for frequent flyer miles and seat assignments. For mileage accrual information, please contact the carrier directly for details.

Seat assignments:  We block group seats with many major carriers, as well as chartered air carriers.  We have absolutely no control over seat assignment. Specific seat requests are subject to availability at airport check-in only or passengers may contact the airlines for individual specific seating once tickets have been issued.  Passenger “Record locators” are assigned by the airlines once the airlines has ticketed each Passenger from the group block. This usually occurs between 60 to 30 days prior the departure date.   After the airlines have assigned each traveler a “Record Locator”, travelers may contact the airlines directly to discuss his or her seat preference.  Airlines may impose to Passenger additional fees for specific seats.

Airline Deposits:  When Passenger Service fee / Deposit is received, We will request the appropriate air space.  Most airlines require a “per seat” or full amount deposit to hold space once group has been confirmed.  Deposits vary with each airline, as well as their terms and cancellations penalties. Airfares quoted are based on non-refundable, contracted fares booked in a specific class of service, and are subject to space availability.  Once air space is confirmed, air deposit and air tickets are non-refundable.  In the event that the airline cannot confirm the required class of service, We will negotiate for the next best possible airfare and advise You of the supplement.

Changes to a service or a reservation by a Passenger:  Any changes to or deletions from the program by a Passenger, including air deviations from the itinerary (prior to ticketing) and name changes on the air, land or cruise portion are subject to a charge of $50.00 per change, per person (plus any additional costs in airfares, airlines deviation fees, cruise or hotel fares or any other services these changes may incur).  Once issued, airline tickets cannot be changed for re-routing and are 100% non-refundable.  Name changes due to spelling corrections are subject to airline rules, and penalties for re-ticketing will apply. In the unlikely event that it becomes necessary or advisable, or for any reason whatsoever, to alter the itinerary or arrangements, such alterations may be made.  Additional expenses, if any, shall be borne by the passenger; conversely, refund will be made to the Passenger if any savings is affected thereby.  We reserve the right to decline, to accept or retain any Passenger as a member of any tour at any time, and a refund for the unused portion of the tour is the limit of our liability in such instance. The usual passage contract in use by the applicable transportation company, when issued, shall constitute the sole contract between said transportation company and the purchaser of this tour and/or the Passenger.  THERE IS NO REFUND FOR ANY UNUSED PORTION OF THE TOUR. 
 
Taxes:  As of the date of this proposal, local and central government taxes are included for all services as levied by the governments of the USA and countries visited as specified.  In the unlikely event that tax structures are amended at any time prior to the travel date, Jet Vacations LLC will pass on all such additional taxes to the Passenger, for collection. Airport and airline taxes and fees are not included unless stipulated otherwise.

CRUISES:
Cabin Assignment: Depending upon the vessel, cabin numbers may be assigned at the time of reservation. Assignments are subject to change. Jet Vacations LLC also reserve the right to amend cabin assignments onboard without prior notification. Unless specified otherwise, shore excursions are not included in the cruise package and may only be purchased aboard ship.  Optional tours / events may be available for advance purchase by contacting Jet Vacations LLC.


Ship & Itinerary Changes: Cruise itineraries and ships are subject to change without notice. Jet Vacations LLC takes no responsibility for ship / vessel substitutions or itinerary changes imposed by a cruise line (or any supplier including but not limited to:  Airline, Coach company, train, hotel etc…) and is not responsible for any losses You may incur including the issuance and/or cancellation of airline tickets or visa fees.

Inability to Sail: Neither Jet Vacations LLC nor the owners or operators of the vessels shall be liable for delay or inability to sail or perform due to any condition or unforeseen circumstances as listed (but not limited to) in our RELEASE FROM LIABILITY section below,  caused by or arising from water level, tides, weather, inoperable locks, strikes, lockout, civil or labor issues, explosion, fire, collision, vessel breakdown or damage to the vessel, its hull, machinery or fittings. Neither shall they be responsible for issues caused by or arising from force majeure, civil commotion, riot, insurrection, war, government restraint, requisitioning of the vessel, political disturbance, acts or threats of terrorism, epidemics, pandemics or the threat thereof, inability to secure or failure of supplies including fuel, Acts of God, or other circumstances beyond their control.  In such cases, part or all of the cruise itinerary may be operated by motor coach and accommodations provided by hotels.  When the option exists, the operator will "swap ships" with another vessel possibly sailing in the opposite direction or on a different itinerary.  Crew, ship and cabin configuration may differ.  If one of these options becomes necessary, Jet Vacations LLC will endeavor to provide equal or similar services, however no tour will be canceled and no monetary compensation will be made for those changes.

Cruise ships / vessels: 
(a) Noise, Vibration and Odor: While Jet Vacations LLC takes reasonable steps to minimize noise, vibrations and odors on the cruise ships, Passenger acknowledge and accept that some noise, vibration and intermittent odors may be experienced on vessels and that Jet Vacations LLC will not be liable to Passenger in relation to any such noise, vibration or odors.
(b) Docking Position: During port stops, ships may dock side-by-side, obstructing views and requiring Passenger to pass through other ships to embark and disembark.
Medical Services: Ship’s crew may be able to provide basic first-aid, however ships do not carry a doctor or nurse onboard. Should professional medical attention be required, local services will be contacted upon the Passenger's request.

Tour Rate Does Not Include:  Travel insurance, Passport fees, visa fees, visa handling fees, laundry, valet service, gratuities on ships, gratuities to guides and drivers, airport taxes wherever levied, additional baggage in excess of allowance, baggage and accident insurance, wines and liquors, mineral waters, food and beverages not on the menu of the included meals, unless otherwise specified in the itinerary, and any other expenses of a personal nature.

Gratuities: Gratuities are not included to the tour/cruise director, motor coach driver, tour guide and baggage handlers.  These are at the participant’s discretion.  A guideline for gratuities is as follows:
€5.00 per person per day for the Tour / Cruise director,
€2.00 per person per day for the guide
€1.00 per person per day for the driver, 
€3.00 per day for a driver/guide (one person) operation 
€1.00 per bag for the baggage handler.

Travel Documents:  Travel documents will be sent approximately 2 weeks prior to departure, providing full payment has been received. Jet Vacations LLC is not responsible for lost or stolen documents; therefore, any re-issuance of documents may be assessed their full-face value and may include increase in cost. A special handling fee of $35 will be assessed to bookings that require overnight express delivery. Overnight delivery requests will be accepted up until 2 p.m. Eastern Time, Monday through Friday. No Saturday or Sunday deliveries.  Some trip documents are sent as E-Documents by email.  For all trip documents, it is the Passenger’s responsibility to check the accuracy of their airline tickets and all other documents.  Passengers are responsible to ensure that their full, official name is provided to Jet Vacations LLC at the time of booking, exactly as it appears on their valid passport, and in a legible way. It can cost up to $250 or more per person for a name change or other ticket adjustments, plus any fare increase if applicable, due to re-ticketing.  The airline will deny boarding if the Passenger airline ticket or documents do not match their passport.  Jet Vacations LLC will not be responsible for Passengers who are denied boarding due to inaccurate information.


Insurance:  Jet Vacations LLC make every effort to ensure that all suppliers /contractors carry appropriate insurance for the supply of the service they are providing. However, it shall be the responsibility of all Passengers to arrange their own travel insurance.

Passenger Travel protection plan: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Travel protection insurance is not included in tour price and can optionally and conveniently be purchased directly with Jet Vacations LLC at the time of booking.  It is strongly recommended that Passenger take advantage of our Travel Protection Plan in the event that You need to cancel or interrupt your trip, require emergency medical assistance, experience a travel delay or lose your baggage.  The plan that We suggest is administered by a third-party travel insurance provider and the contract for this service is therefore between You and the Insurance Carrier and based on their terms and conditions.  It is your responsibility to read and study the travel insurance plan suggested and to understand its Terms & Conditions - as listed on their web site at https://www.travelinsured.com or brochures, so that You may select an insurance plan that is adapted to your specific needs and requirements.  All insurance claims have to be directed to the Travel Insurance company. Those terms and conditions are provided on their website.  The Travel Protection Plan is not in effect until your payment for the plan is received, and the Travel Insurance premium is non-refundable and has to be purchased within five (5) days of booking to include pre-existing conditions.  Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.

Safety: It is the responsibility of each Passenger to ensure that they do not behave in such a way as to cause offence or danger to themselves or others, or which risks damage to property.  Each Passenger shall be responsible for any injury or damage caused by their failure to behave in a safe and proper manner.  It is your responsibility to ensure that You and the members of your party do not behave in a way which causes offense or danger to others or which risks damage to property belonging to others. To ensure the smooth running of the tour, Jet Vacations LLC reserves the right to accept, reject or expel any individual who is deemed disruptive or incompatible with the interests of the group, including, but not limited to:
(a) if it is reasonably believed that a Passenger is dangerous to others or to themselves; 
(b) has engaged in or threatening to engage in behavior that may adversely affect the safety, security, well-being or enjoyment of other Passengers; 
(c) who are intoxicated and/or under the influence of drugs 
(d) who has failed or refused to follow Jet Vacations LLC’s rules and procedures or the instruction of Jet Vacations LLC’s employees or representatives / suppliers. 
(e) who has engaged in the destruction of property.
In such circumstances, all suppliers (including but not limited to airlines, hotels, Cruise ships, trains, coach operators, tour managers or tour guides, official sites – museums – monuments, etc...) and Jet Vacations LLC have the right to terminate arrangements made on your behalf, in which case Jet Vacations’ responsibility to the Passenger ceases immediately.  Expenses, including cancellation fees and/or costs for alternate travel plans or to return home, will be the responsibility of the passenger.  There can be no refunds, no payment of compensation and no reimbursement of any cost or expenses You may incur as a result.  All unused services are non-refundable.  Furthermore, You will be liable to reimburse Jet Vacations LLC and/or its suppliers damages for any expenses whatsoever as a result of your behavior.  Jet Vacations LLC shall be entitled to recover from the individual any cost or expenses incurred by Jet Vacations LLC or its supplier or representative in the removal of the individual.

Sightseeing & Itinerary: Escorted tours are operated by motor-vehicle, its size dictated by the number of participants.  Jet Vacations LLC programs have been designed for groups.  Times listed in itineraries are approximate and meant only as guidelines.  Some itineraries may have early morning start times for sightseeing in order to complete the touring during daylight hours or avoid afternoon heat in tropical and desert climates.  It is your responsibility to arrive on time for all scheduled flights, cruises, trains, coaches and package components.  Arriving late may be considered a "no-show", in which case You will not be eligible for refund for the unused service(s).

Itinerary variation: We will make every effort to operate all tours as advertised.  Situations beyond Jet Vacations’ responsibility may arise, voluntarily or involuntarily, that require changes or exceptions in the service dates, airport of departure, the itinerary, air and land arrangements, hotels, trains or cruise ports of call.  On dates including, but not limited to religious holidays and national celebrations, some monuments and sites may be closed.  National monuments and tourist sites regularly undergo renovations, which can obscure the monument's view.  Occasionally, during holidays and certain periods, and/or due to unforeseen circumstances as listed (but not limited to) in our RELEASE FROM LIABILITY section below, there may be changes, sometimes months prior departure, sometimes after arrival, affecting the sequence of the tour, locations visited and/or hotels / cruise ships.  Therefore, on these occasions, your trip and/or touring itineraries may be amended to reflect these closures and We reserve the right to make such modifications and substitute conveyances/hotels/cruise ships and any other sites or services as deemed necessary, adjust the sequence and/or substitute any hotels/cruise ships and any other sites or services with others of similar category.  In such cases there will be no cost adjustment.  No tour will be canceled due to renovations or closures.  Jet Vacations LLC will decide based on the conditions whether to amend an itinerary.

Optional Tours and Sightseeing: On certain programs, We offer a variety of optional tours that can be pre-purchased prior to your departure. For others, You will receive information about optional tours (if available) for purchase upon arrival in your destination. Jet Vacations LLC review these tours and the companies operating them, for appropriateness and quality.  Generally, Passenger should sign up for the optional tours they wish to take at the start of your tour.  You are under no obligation whatsoever to participate.  Sightseeing is subject to final arrangements by local tourist authorities, based on conditions such as minimum number of participants required to operate, weather, time, etc.  Facilities such as museums, monuments, sites and banks, restaurants and sightseeing tours maybe closed on certain dates due to, but not limited to, religious holidays and national and regional celebrations, etc...

Group - Individual pictures-videos taken during a trip:  Jet Vacations staff may take photographs or videos of Passenger(s) of group participants during a trip.  By participating in a Jet Vacations trip, You grant Jet Vacations LLC the right to use the photographs - videos in connection with the identified event to be used for any lawful purpose including marketing, publicity, illustration, advertising and web content purposes – without payment of any compensation to Passenger.

Travelers requiring special assistance - disabled participants:  In order to fully enjoy your Jet Vacations LLC tour, we recommend that you select a trip that is suitable to your physical capabilities. Tour participants requiring any form of assistance, including travelers with physical disabilities, sight, hearing or mobility impairments, are required to notify Jet Vacations LLC prior to booking a tour. We regret that some itineraries cannot accommodate wheelchairs or motorized scooters. Jet Vacations LLC will review the tour requirements with you to determine the level of assistance you may need and to ensure that the trip you have selected is suitable for you. Please be aware that the Americans with Disabilities Act (ADA) is only applicable within the United States and facilities for disabled individuals are limited outside of US borders.  Passenger must inform us in writing, at or immediately after making the reservation, but in any event as early as possible, of any mobility impairment or other condition, whether physical, emotional or mental, which may require accommodation or use of an assistive device during the travel.  If the impairment or condition first arises after making the reservation, participant must inform us in writing as early as possible.  We may consider, and may confer with Passenger, the cruise operator, airlines, hotels and other service providers regarding possible accommodations.  A reasonable effort will be made to accommodate special needs, but We are not responsible for denial of service by carriers, hotels, cruise lines or other independent suppliers. A Passenger who, due to impairment, is not self-sufficient, may be required to travel with a companion who shall take responsibility for assistance needed during the travel and in case of emergency.  A Passenger with a disability that would result in a direct threat to the health and safety of others or to that individual may be excluded, if it is determined there is a significant risk that cannot be eliminated or reduced to an acceptable level by reasonable accommodations, policies, practices, procedures assistive devices or services.  If Passenger fails to timely inform us of any impairment or condition, and it is determined based on information that Passenger should have provided, that participation poses a safety risk to Passenger or direct health or safety threat to others, Passenger may be excluded from parts or all of the travel.  Jet Vacations and its suppliers shall have no liability to Passenger relating to any condition, treatment, failure to inform us of an impairment, or resulting exclusion.  We regret that We cannot provide individual assistance for walking, dining, embarking/disembarking transportation, and/or for other personal needs.  A qualified companion must accompany Passenger who need such assistance.

(a) Special needs: We welcome You if You have a disability or other special need, provided You are accompanied by a companion capable of providing all the assistance You require.  Please note that although We will use reasonable endeavors to provide You with all the activities on Your Itinerary, depending on Your disability, You may not be able to participate in every activity and Jet Vacations, its representative, Tour Director, Captain or Cruise Director will have the right to refuse Your participation if Jet Vacations LLC, its representative, Tour Director, Captain or Cruise Director believes Your health and safety or the health and safety of any other person may be impacted by Your participation.  You must advise Us of any disability, medical condition or dietary requirement at the time of Booking.

(b) Facilities: Regarding Motor Coaches and Cruise transportation, it is important to note that:
(i) for safety reasons, passengers in wheelchairs cannot be carried on boarding ramps (which on cruises may be steep due to water levels) while the vessel is tied up or at anchor, or on to motor coaches, tenders; and
(ii) collapsible walkers may be taken onto coach tender vessels for transfer to shore for the included touring.
(iii) motorized scooters cannot be used on board airlines, cruise ships, motor coaches,
(iv) wheelchairs and walkers can be carried in the luggage compartment of motor coaches subject to space limitations.
(c) Our discretion: We may, in Our absolute discretion, decline Your Booking if We are of the view that:
(i) We cannot adequately provide for any or all of Your special needs;
(ii) Your health, safety or enjoyment, or that of any other passengers attending the Tour may be at risk; or
(iii) You cannot or will not abide by any reasonable directions of the Captain, Discovery Team Leader or Cruise Director.
We assume no responsibility for and shall not be liable for the suitability for a disabled person of any portion of any trip.

Emotional or Service Animals: Passengers on escorted tours who require an emotional or service dog because of a disability should check with Jet Vacations prior to booking a tour.  Jet Vacations LLC contracts with different suppliers in each country who, in turn, contracts with local vendors to provide services. hotels, restaurants, transportation, activities and excursions to You on each trip.  Each such vendor may have its own requirements related to emotional or service animals in addition to those required by each country’s regulations. Once you inform Jet Vacations LLC of your desire to bring an emotional or service animal on your trip, Jet Vacations LLC will contact the suppliers for your trip to confirm the then-current requirements of each vendor to permit emotional or service animals to, among other things, 
(i) enter a hotel and stay in a guest room, 
(ii) enter and remain in each restaurant during a meal, 
(iii) use the group transportation or 
(iv) enter, remain and participate in the activities or excursions on each itinerary. 
Jet Vacations LLC will provide you with the supplier documentation requirements, which will be current as of the date Jet Vacations LLC collects such information from the tour operator.  Because supplier documentation requirements may change at any time in the sole discretion of the supplier, Jet Vacations LLC cannot be responsible for changes to such vendor requirements.  Due to the nature of the group travel experience, if for some reason your emotional or service animal is stopped, delayed or detained at any time during your trip, Jet Vacations LLC may need to continue the tour with the rest of the group without you. Once the issue has been resolved, You will make arrangements to reunite with the group and you may incur additional costs.  Jet Vacations LLC will not compensate you for any portion of your trip that you miss or in which you are unable to participate.

Special requests: We will make reasonable efforts to secure special request and dietary needs. However, requests cannot be guaranteed. For room / cabin requests other than what is advertised, there may be an additional cost. We cannot be held responsible for the failure of carriers, hotels, cruise lines or other suppliers to deliver such requests.

Pregnancy: For the safety of parent and child, and depending on various circumstances, passengers who are at an advanced stage of pregnancy (after 5 months) may be subject to restrictions or exclusion concerning their ability to travel and/or board a ship. Please inform us immediately, so We can assess your personal circumstances and possible accommodation.


Postponing of a tour by Jet Vacations:  As clearly mentioned in our GENERAL PROVISIONS below, Jet Vacations LLC seeks to provide services as published or stated in the final Passenger documents.  But conditions, events (as listed below in the RELEASE FROM LIABILITY section but not limited to) may affect travel arrangements, planned tours, cruises, itineraries or any other aspects of the travel experience, making traveling to a location (including but not limited to countries, cities, sites, etc..), tour or cruise routes unsafe for traveling / navigation or in other respects, raise sufficient doubt about safety. In these unforeseen circumstances beyond Jet Vacations’ responsibility, Jet Vacations LLC reserves the right to postpone a trip and make date modifications along with substitutions on airlines/conveyances/hotels/cruise ships and any other sites or services as deemed necessary as well as adjust the sequence and/or substitute any hotels/cruise ships and any other sites or services with others of similar category.  In the event that it becomes necessary or advisable, or for any reason whatsoever to postpone a trip, such alterations may be made and Jet Vacations LLC will decide based on the conditions whether to postpone a trip.  Passenger understands that depending on the gravity of the situation, the postponing of a tour may result in several days / months / even years delay (in such events as listed but not limited to our Release of Liability section).  Such changes and/or the postponing of a trip by Jet Vacations LLC will not entitle Passenger to any credit or a refund.  NO REFUNDS WILL BE POSSIBLE DURING A TRIP POSTPONEMENT AS PASSENGERS PAID FUNDS WOULD HAVE ALREADY BEEN ALLOCATED AND PAID OUT TO MULTIPLE SUPPLIERS TO SECURE THE FUTURE TRIP.  Jet Vacations LLC may offer an alternate choice to the Group Participant and this in addition to the new postponed trip.  In such cases there will be no cost adjustment.  No trip will be deemed canceled due to the Postponement by Jet Vacations LLC of a trip.  In the event of a Postponement of a trip by Jet Vacations LLC, PASSENGER FULL TERMS AND CONDITIONS as well as PASSENGER CANCELLATION POLICIES STILL APPLY.  Additional expenses for postponing due to circumstances beyond the control of Jet Vacations, if any, shall be borne by the Passenger; conversely, a refund will be made to the Passenger if any savings is effected thereby.  

Tour Cancelation by Jet Vacations: We reserve the right to cancel the entire trip (or any component of the trip) for any reason and/or time. In this event, our liability, if any, shall be limited to and liquidated by refunding to each prospective Passenger the payments made.

Complaints: Jet Vacations LLC is concerned that all booked services are provided. In the event of any complaint concerning a service, the complaint should in the first instance be raised with the appropriate supplier/contractor. In the event that the complaint is not resolved, the Passenger should call Jet Vacations LLC emergency number.  A written complaint shall be made to Jet Vacations LLC within seven (7) days after the termination of the tour. No complaint shall be entertained outside of seven (7) days after the termination of the tour.

PASSENGER CANCELLATION POLICY

Upon booking / registering on a Jet Vacations LLC tour:  No charges are levied for individual Passengers canceling 29 days after registering on a Jet Vacations LLC tour.  30 days after booking / registering on a Jet Vacations LLC tour and up to 120 days (150 days for cruises) prior to the commencement of a Jet Vacations LLC tour, whichever comes first, penalties will be applied as per the Cancelation schedule below (See Cancellation section below).  However, services which have been prepaid by Jet Vacations LLC on behalf of Passengers maybe non-refundable, non-exchangeable, non changeable and/or maybe subject to a cancellation- change fee (e.g. service fees, theater tickets, train tickets, airline tickets, event tickets, passes, entrance fees etc.).  30 days after booking / registering on a Jet Vacations LLC tour, cancellation fees will not be less than the initial non-refundable Service Fee.

Cancellation by a Passenger: (unless otherwise indicated on the specific tour and/or group master contract)
For individual Passengers canceling 30 days after registering on a Jet Vacations LLC tour, or up to 120 days (150 days for cruises) prior to the commencement of a Jet Vacations LLC tour, whichever comes first, cancellation fees will not be less than the initial non-refundable Service Fee. Changing the dates of a group by a passenger is deemed to be a full cancellation; the application of the terms and conditions relating to cancellation apply. Failing to pay the contractual deposits (other than the initial service fee/deposit) constitutes a cancellation. In the event of non-compliance with the payment due dates, Jet Vacations LLC shall have the right to demand the Passenger to immediately pay the outstanding balance for the group. Payment shall then be received by Jet Vacations LLC within eight (8) days as of the date of Jet Vacations LLC’s request. Should payment not be received within this time limit, the group stay shall be deemed to be canceled by the Passenger. In the event of full cancellation of the agreement by the Passenger, which is not justified by Jet Vacations LLC’s failure to meet its obligations, cancellation penalties shall be invoiced and calculated as follows:

Land group programs:
30 days after booking / registering on a tour: $300 Service Fee is non-refundable.
From 120 to 91 days prior departure: Initial Service Fee / Deposit are non-refundable.
From 90 to 46 days prior to departure: 50% penalty of the total cost per person.
From 45 to day of departure or No Show: 100% penalty (for group or individual cancellations).

Cruise Programs: 
30 days after booking / registering on a tour: $300 Service Fee is non-refundable.
From 150 to 91 days prior departure: Initial Service Fee / Deposit are non-refundable.
From 90 to 61 days prior to departure: 75% penalty of the total cost per person.
From 60 to day of departure or No Show: 100% penalty (for group or individual cancellations).

If a Passenger cancellation creates a change in the price schedule, the tour price will be revised based on the remaining number of participants.  A Passenger becoming a single as a result of a partner’s cancellation must pay the single supplement.

NOTE: The following non-refundable fees will be added to the penalty charges listed on the cancellation schedule above:
• Service fees from (and not limited to) Jet Vacations, operators, airlines, hotels, cruise lines, coach companies, reservation sites etc….
• Travel protection premiums. 
• Airline tickets - airline penalties: Once airfare is purchased, either at time of booking for instant purchase airfare or at time of full payment, airline tickets are subject to 100% penalty of the ticket value.
• Theater tickets, train tickets, event tickets, passes, entrance fees etc… Once tickets are purchased, either at time of booking for instant purchase airfare or at time of full payment, Theater tickets, train tickets, event tickets, passes, entrance fees are subject to 100% penalty of the ticket value.


 

GENERAL TERMS & CONDITIONS

GENERAL PROVISIONS:
Jet Vacations LLC seeks to provide services as published or stated in the final Passenger documents.  But events beyond Jet Vacations’ responsibility (as listed in the RELEASE FROM LIABILITY section below but not limited to) may affect travel arrangements, planned tours, cruises, itineraries or any other aspects of the travel experience. If conditions or events make traveling to a location (including but not limited to countries, cities, sites, etc..), tour or cruise routes unsafe for traveling / navigation or in other respects, or raise sufficient doubt about safety, We reserve the right to modify or provide alternate services. These may include, but are not limited to, postponing an entire trip to an earlier or later date, deviating from and original itinerary, changing airline, providing accommodation on another ship or hotel and/or substituting ground arrangements.  An effort will be made to try to arrange elements of the tour or cruise similar to those originally planned. But the level of similarity may vary. Such changes and/or the postponing of a trip will not entitle Passenger to any credit or refunds.  Tours and/or cruise dates, routes, and all other aspects of the tour/cruise and travel are subject to change with or without notice. I, Passenger understand that events beyond Jet Vacations LLC ‘s responsibility may result in the postponing, deviating, changing, or substituting components of the trip in which I will be participating and that alternate options will be provided to me at that time.  I agree not to initiate a credit card dispute / chargeback against Jet Vacations for changes beyond Jet Vacations control.

GENERAL POLICY:
RECEIPT OF YOUR RESERVATION DEPOSIT/PAYMENT ON A JET VACATIONS LLC TRIP SHALL BE DEEMED CONSENT OF THE TERMS AND CONDITIONS AND RELEASES OF LIABILITY HEREIN.

AGENT FOR TRAVEL SUPPLIERS: Jet Vacations LLC does not own or operate any entity which is to or does provide goods or services for its trips including, for example, ownership or control over hotels, or other lodging facilities, airline, cruise ships/vessel, bus, van or other transportation companies, local ground operators, providers or organizers of optional excursions or equipment used thereon, food service, restaurants or entertainment providers, etc. All such persons and entities are independent contractors. Jet Vacations LLC acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”).  We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and we have no liability for recommending a trip credit in lieu of a refund.  As a result, Jet Vacations LLC is not liable for any negligent or willful act or failure to act of any such person or entity, or of any other third party.

RULES OF TRAVEL SUPPLIERS AND GOVERNMENTS: Jet Vacations LLC has no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as health affidavit forms, health screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest travel supplier requirements, check the supplier’s home page.

REBOOKING: If requested, we will assist with obtaining any refunds due or rebooking trips using future credits, but we will charge a nonrefundable fee for such services.

RELEASE FROM LIABILITY: Without limitation, Jet Vacations LLC., our agents, employees, officers, directors, associates, affiliated companies, guides,  group  leaders, and subcontractors, (collectively "Jet Vacations LLC") assume no responsibility for and shall not be liable for the acts or omissions of any party not under our control, and shall not be responsible for any injury, loss, or damage to person or property, death, delay or the suitability for a disabled person of any portion of any trip, or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God, acts of government, force majeure, natural disasters, power shortage or failures, fires, inclement weather, acts of war or civil commotion, acts of restrictions by governmental agencies, political unrest, insurrection or revolt, kidnappings and ransom, strikes or other labor disruptions or activities, criminal or terrorist activities of any kind, or the threat thereof, bankruptcy and insolvencies, overbooking or downgrading of accommodations, structural or other defective conditions in hotels, cruise ships or other lodging facilities, mechanical or other failure of airplanes, vessels, vehicles or other means of transportation or for any failure of any transportation mechanism to arrive or depart timely or safely, dangers associated with attacks or bites from animals, pests or insect born illness, marine life or vegetation of any sort, dangers incident to recreational activities such as swimming, kayaking, sailing, canoeing, rafting, hiking, walking, running, bicycling, etc., sanitation problems, food poisoning, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, illness, epidemics, pandemics or the threat thereof, water level rising or dropping, high altitude sickness or for any other cause beyond the direct control of Jet Vacations LLC. 

RESPONSIBILITY:  It is each Passenger’s responsibility to make sure that they read, agree, accept and abide to the Terms and Conditions and Passenger Agreement as outlined on our web site at www.jetvacations.com, or received by email, fax or via invoice.  Jet Vacations LLC acts as a sales agent for any airlines, hotels, car rental companies, cruise lines, transfer companies, coach companies, sightseeing companies, or other service providers named on your ticket, other travel documents, or your itinerary (Suppliers”).  Jet Vacations LLC is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.  Jet Vacations LLC assumes no responsibility for, and shall not be liable for, any refund, personal injury, property damage (including damaged baggage), or other loss (including lost baggage), accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, vessel, craft, equipment, or instrumentality owned operated, or otherwise used or proved by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under Jet Vacations LLC’s control.  Jet Vacations LLC has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which You may travel. For information concerning possible dangers at destinations Jet Vacations LLC recommends contacting the Travel Warning Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov.  For medical information, Jet Vacations LLC recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).  You hereby release Jet Vacations LLC from all claims arising out of anything covered by this paragraph.

RISK OF TRAVEL AND RELEASE:  Jet Vacations LLC has no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on "Find International travel Information” then click on "Country Information", and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19. 

ASSUMPTION OF RISK:
I, Passenger, am aware that travel such as that I am undertaking involves hazardous activities, with a risk of illness, injury or death which may be caused by forces of nature, animals, insects or flora, the negligence of Jet Vacations LLC, our agents, employees, officers, directors, associates, affiliated companies, guides,  group  leaders, and subcontractors, or other persons and companies known or unknown, or of willful or criminal conduct of third parties.  I am aware that weather conditions may be severe, adverse and/or unpleasant.  I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip.  In order to partake of the enjoyment and excitement of this trip I am willing to accept the risks and uncertainty involved as being an integral part of my adventure.  I hereby accept and assume full responsibility for any and all risks of illness, injury or death and of the negligence of Jet Vacations LLC and agree to hold harmless and release Jet Vacations LLC our agents, employees, officers, directors, associates, affiliated companies, guides,  group  leaders, and subcontractors, from claims of third-party negligence.

I, Passenger, understand the physical requirements of the activity in which I will be participating, and I currently have no known physical, medical or mental condition which would impair my ability to participate in this tour or my safety in this activity, and I am willing to assume all risks that may be created, directly or indirectly, by any such condition.  I hereby authorize Jet Vacations LLC or the local ground handler or others to arrange for any emergency medical treatment and hospitalization as may be necessary for me because of participation in this activity without my further consent.

YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES,  GROUP  LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS,  CAUSES  OF  ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.  I, PASSENGER, RELEASE JET VACATIONS LLC FROM ITS OWN NEGLIGENCE AND ASSUME ALL RISK THEREOF.

CLAIM DEADLINE AND BINDING ARBITRATION: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year.  I, Passenger, agree that any controversy, claim or dispute arising from, concerning, relating, or referring to this Contract, Terms and Condition, Passenger Agreement, Booking Form, Brochure, or any other literature or information relating in any way to my trip or the trip itself, shall be settled and resolved solely and exclusively by binding arbitration in Naples, Collier County, Florida pursuant to the Federal Arbitration Act, 9 U.S.C. §§1-16, pursuant to the Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS) then existent.  Such proceedings will be governed by substantive (but not procedural) Florida law and will take place in Naples, FL.  The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.  By agreeing to these Terms and Conditions, I, Passenger, (and Jet Vacations LLC) are waiving our right to a trial by jury.

VOLUNTARY PARTICIPATION: I, Passenger, acknowledge that I have voluntarily applied to participate on a trip developed by Jet Vacations LLC or by Jet Vacations LLC’s Group Leader client as designated by a trip application/reservations form (or a trip which I may change to) and that I have read the description of the trip as it appears in the current Jet Vacations LLC or Jet Vacations LLC’s Group Leader Passenger flyers or brochures or reservations form or website relating to the trip, together with all information contained in this Passenger Agreement.  I am voluntarily participating in this trip with full knowledge of the hazards involved.

KNOWING AND VOLUNTARY EXECUTION: I, Passenger, have carefully read these Terms and Conditions, Releases from liability and the booking information sections of this Passenger Agreement document, and fully understand its contents and certify that I am 18 years of age or older. I am aware that this is a release of liability and a contract between myself and Jet Vacations LLC and agree of my own free will. By registering on a Jet Vacations’ travel program, I agree to these Travel Terms & Conditions and Passenger Agreement and Jet Vacations LLC’s Release from Liability, Assumption of Risk and Compulsory Arbitration Clause for myself, each member of my traveling party and any minor children accompanying me.

SEVERABILITY:  In the event that any clause in this agreement is determined to be invalid, the remaining provisions are valid and enforceable. The invalid provision shall be replaced by Jet Vacations LLC by a clause as similar as practicable.

ERRORS AND OMISSIONS:  While every effort is made to ensure the accuracy of information in our brochures, on our website or communicated by our reservation staff, errors or omissions are possible and Jet Vacations LLC is not responsible for such error. If a mistake is made in billing, we reserve the right to correct the invoice and you will be responsible for proper payment.
